Terms governing the distance selling of Art-Squad products. By placing an order, the Customer declares that they have read and accepted them.<\/p>\n<\/div>\n

1<\/span>Seller information<\/span><\/h2>\n

The website art-squad.com<\/a> and the Art-Squad e-shop are operated by Franco Mozzillo di Francesco Mozzillo<\/span>, with registered office at Via Solferino 33 \u2013 81031 Aversa (CE), Italy. VAT no. 03105570612 \u2014 Tax code MZZFNC67D19F839K.

2<\/span>Definitions and scope<\/span><\/h2>\n

Consumer:<\/strong> a natural person acting for purposes unrelated to any business or professional activity. Professional \/ business Customer:<\/strong> anyone purchasing in the exercise of their own activity.<\/p>\n

These Terms govern the distance selling of the products offered on the e-shop. Certain protections (withdrawal, legal guarantee) apply only to Consumers<\/span>.<\/p>\n

3<\/span>Products<\/span><\/h2>\n

Art-Squad sells physical products (t-shirts, mugs, posters and similar) bearing original graphic works by its affiliated artists. Each product bears the name\/pseudonym of the artist who created the work<\/span>.<\/p>\n

Product images and descriptions are as faithful as possible; slight differences in colour or rendering due to screens or printing processes do not constitute a lack of conformity. Availability is indicative: in the event of subsequent unavailability we will notify you and issue a refund.<\/p>\n

4<\/span>Pre-contractual information<\/span><\/h2>\n

Before the order is finalised, the following are always provided, as required by art. 49 of the Italian Consumer Code: characteristics of the goods, total price inclusive of taxes, shipping costs, payment and delivery methods, delivery times, existence of the right of withdrawal and of the legal guarantee of conformity.<\/p>\n

5<\/span>Prices and costs<\/span><\/h2>\n

Prices are stated in Euro<\/span> and include VAT<\/span>, where applicable. Shipping costs are indicated separately before order confirmation and summarised in the cart. The price displayed at the time of the order applies.<\/p>\n

6<\/span>Order procedure<\/span><\/h2>\n

The Customer selects the products, adds them to the cart, enters the required data and confirms the order by clicking the purchase button, which entails an “order with an obligation to pay”<\/span>.<\/p>\n

The contract is concluded when Art-Squad sends the Customer the order confirmation<\/strong> with the summary. Art-Squad reserves the right not to process orders that are incomplete, suspected of fraud or non-compliant with these Terms.<\/p>\n

7<\/span>Payments<\/span><\/h2>\n

Accepted payment methods are: Paypal, Woo Payment, Stripe Payment data is processed directly by the payment service providers via secure connections; Art-Squad does not store full card details<\/span>.<\/p>\n

8<\/span>Shipping and delivery<\/span><\/h2>\n

Products are made to order (print-on-demand)<\/strong> and shipped worldwide<\/span>. Production and shipping are handled by our partner, which prints the product at the most suitable production centre and delivers it directly to the Customer. It is understood that the seller and sole party responsible towards the Customer is Art-Squad.<\/p>\n

Estimated delivery times are 4-8 working days<\/span> (production + shipping) and may vary depending on the destination. Times are indicative and non-essential, except for force majeure and subject to the statutory maximum of 30 days.<\/p>\n

The risk<\/strong> of loss or damage passes to the Consumer upon physical delivery to them or to a third party designated by them (other than the carrier).<\/p>\n

International deliveries \u2013 duties and taxes.<\/strong> For shipments outside the EU, the price shown does not include customs duties, taxes and import charges<\/span> applied by the destination country, which are borne by the Customer and may be requested upon delivery.<\/p>\n

9<\/span>Product safety (GPSR)<\/span><\/h2>\n

The product pages show the information required by Regulation (EU) 2023\/988, including the identity and contact details of the manufacturer or the economic operator responsible in the EU and any warnings or safety instructions.<\/p>\n

10<\/span>Right of withdrawal<\/span><\/h2>\n

The Consumer has the right to withdraw within 14 days<\/span> according to the terms set out in the Returns, Right of Withdrawal & Refunds<\/a> document, which forms an integral part of these Terms.<\/p>\n

11<\/span>Legal guarantee of conformity<\/span><\/h2>\n

The products are covered by the 24-month legal guarantee of conformity<\/span> provided for by articles 128 et seq. of the Italian Consumer Code, as specified in the Returns, Right of Withdrawal & Refunds<\/a> document.<\/p>\n

12<\/span>Intellectual property<\/span><\/h2>\n

The contents of the e-shop (the “Art-Squad” trademark, logo, texts, layout) are owned by Art-Squad or the respective rights holders.<\/p>\n

The graphic works<\/strong> reproduced on the products remain the property of their respective artist authors<\/span> and are used under licence. Purchasing a product does not transfer any copyright<\/span> in the work: the Customer buys the physical item, not the rights to the artwork. Reproduction of the graphics for commercial purposes without authorisation is prohibited.<\/p>\n

13<\/span>Complaints and dispute resolution<\/span><\/h2>\n

For any complaint the Customer may write to contact@art-squad.com<\/a>; we undertake to respond within 3 working days<\/span>. For out-of-court dispute resolution, it is possible to turn to the competent ADR bodies<\/strong>.<\/p>\n

14<\/span>Force majeure<\/span><\/h2>\n

Art-Squad is not liable for failures to perform due to force majeure or unforeseeable events beyond its control.<\/p>\n

15<\/span>Applicable law and jurisdiction<\/span><\/h2>\n

These Terms are governed by Italian law<\/span>. For the Consumer, the court of the Consumer’s place of residence or domicile<\/strong> has exclusive jurisdiction. For business Customers, the Court of Napoli Nord has jurisdiction.<\/p>\n

16<\/span>Modifiche<\/span><\/h2>\n
